Welcome to Tippy. These Terms of Service ("Terms") govern your access to and use of the Tippy mobile application ("App," "Service," or "Tippy"). By accessing or using Tippy, you agree to be bound by these Terms.

Age Requirement: You must be at least 18 years old to use Tippy. By using our Service, you represent and warrant that you are 18 years of age or older.

1. Acceptance of Terms

By creating an account or using Tippy, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Tippy is a decision-making platform that allows users to:

Create and share polls with images or text options
Vote on polls created by other users
Use AI-powered assistance for decision-making
Use random selection tools to help make choices
Interact with a community of users

3. User Accounts

3.1 Account Creation

To use certain features of Tippy, you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account
Be responsible for all activities under your account
Notify us immediately of any unauthorized use

3.2 Account Termination

You may delete your account at any time through the app settings. We reserve the right to suspend or terminate your account if you violate these Terms.

4. User Content and Conduct

4.1 Your Content

You retain ownership of content you create and share on Tippy. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the Service.

4.2 Prohibited Content and Conduct

Zero Tolerance Policy: We maintain a strict zero-tolerance policy for the following:

Harassment, bullying, threats, or intimidation
Hate speech, discrimination, or promotion of violence
Sexually explicit, pornographic, or suggestive content
Content involving minors in any inappropriate context
Graphic violence, gore, or disturbing content
Illegal activities, drugs, or weapons
Spam, scams, or fraudulent content
Impersonation or misleading information
Copyright or trademark infringement
Attempts to hack, exploit, or abuse the Service

Violation of these policies will result in immediate account termination without warning.

4.3 Content Moderation

We reserve the right to review, monitor, and remove any content that violates these Terms. However, we are not obligated to monitor all content and are not responsible for user-generated content.

5. Tips and In-App Purchases

5.1 Virtual Currency

Tippy uses a virtual currency called "Tips" that can be purchased through Apple's In-App Purchase system. Tips can be used to access certain features, including AI Helper services.

5.2 Purchases

All purchases are processed through Apple's payment system
Prices are displayed in your local currency
All sales are final and non-refundable except as required by law
Tips have no monetary value and cannot be exchanged for cash
Tips cannot be transferred between accounts

5.3 Refunds

Refund requests must be made through Apple's App Store. We do not process refunds directly.

6. AI Services

Our AI Helper feature uses third-party AI services to provide decision-making assistance. By using this feature:

You acknowledge that AI responses are generated automatically and may not always be accurate
You agree not to rely solely on AI suggestions for important decisions
You understand that AI services require Tips to use
You agree that your messages may be processed by third-party AI providers

7. Intellectual Property

The Tippy app, including its design, features, and content (excluding user-generated content), is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

8. Privacy

Your use of Tippy is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

9. Reporting and Blocking

We provide tools to help you control your experience:

Report: You can report content or users that violate these Terms
Block: You can block users to prevent seeing their content

We take reports seriously and will investigate violations promptly.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We are not responsible for:

User-generated content or interactions between users
Decisions made based on polls or AI suggestions
Loss of data or Tips due to technical issues
Third-party services or links

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the Service, your content, or your violation of these Terms.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the app or on our website. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Termination

We reserve the right to suspend or terminate your access to Tippy at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tippy regarding the use of the Service.
